How to Get a Divorce in the UK?

Who Can File a Divorce?


Divorce applications are only approved if:

  • You have been married for more than a year. *
  • Your marriage is legally recognised in the UK. **
  • Your marriage cannot work anymore.
  • You or your partner has a permanent home in the UK.

When Can You File for a Divorce?


When applying for a divorce, you must prove that your marriage has broken down permanently. It is only possible if you have a valid reason for stating that your relationship can not work. Here are five reasons that are accepted by the English family law:

If you can prove that your partner is unfaithful and has had an extramarital affair. Do note that you cannot file for a divorce if you continued to live with them for over six months after finding out that they cheated on you.

When your partner behaves unreasonably and makes it impossible for you to continue the marriage. The most common reasons include: drug abuse, alcoholism, domestic abuse (physical and emotional), and failure to pay their share of expenses (for your home/child care).

If you and your spouse have not lived together for a minimum of two years before you file for divorce. In this case, both partners must agree on filing for divorce to receive approval from the court.

If you have been living separately for at least five years, you can apply for divorce. The court does not ask for consent (approval) from the other party in these cases.

You can apply for a divorce if your partner has left you for over two years with the intention to remain permanently seprated. The court needs proof of other party’s intention to leave your forever. No matter what the situation is, the final verdict of the divorce has a big impact on your life. If mishandled, it can cause financial problems and emotional distress in the long run. The court fee for filing a divorce in England and Wales is £550. If you are on low income or claiming any state benefits, you may apply for court fee exemption. We offer a fixed-fee of £500 (plus VAT) for filing an undefended divorce. For respondents (i.e., the partner who answers a petition) our fee is £300 (plus VAT) for undefended divorces. For defended divorces or complicated matter, we will discuss our fees with you at the initial consultation.
